PRIVACY & DATA COLLECTION POLICY
INTRODUCTION
1.1. Purpose
The DOX BOX Community consists of online members who are documentary artists and activists committed to telling stories around social and humane causes. Members are able to gather via a virtual platform that provides the means and ways to develop films in Arab countries, share and promote works that will be exposed to several different audiences regionally and internationally, with the overriding goal of leaving lasting impacts on society.
1.2. General Terms of Agreement
This site is owned and operated by DOX BOX e.V. in Berlin - Germany (referred to as "DOX BOX", "we", or "us"), offering an online portal („the portal“). "You" are the person(s) using the portal. The Terms & Conditions may hereinafter simply be referred to as “these terms”. By registering as a member, and accessing or using this portal, you agree to be bound by these terms. Please read them very carefully.
These terms contain the entire understanding and agreement between us and you in relation to your use of the portal, and supersedes and replaces any representation, statement or other communication (whether written or otherwise) made by you or us which is not contained herein.
Should any part of these terms and conditions for any reason be declared invalid or unenforceable by a court of competent jurisdiction, then that particular part will be removed from these terms. This however shall not affect the validity and enforceability of any other part of the remaining terms.
These terms and conditions are governed and construed in accordance with the laws of Germany and you consent to the exclusive jurisdiction of the courts of Germany.
1.3. Code of Ethics
This is the DOX BOX Code of Ethics, you agree that you will do your best to abide by it:
- Ensuring credibility and reliability with regards to all sources of supplied information in all forms, and the clarity of rights and the ability to provide advice and assistance from trustworthy specialists.
- Respecting the right of people and artifacts alike, including privacy, intellectual copyrights, and artistic rights.
- Respecting all creative work, cultural and artistic differences, and focusing on individual experiences or specific schools by constantly enhancing technical references and expanding the circle of discovery.
- Standing in solidarity with, and in support of, the protection of members in regards to defamation, arrest, or violation of intellectual property; in other words, remaining vigilant to any infringements on any and all members’ practices or freedoms, creative or otherwise.
- Supporting an emerging generation of artists by encouraging and taking into account their contributions and suggestions and helping these individuals express themselves in representing their own communities.
- Appreciating and encouraging a free-flowing exchange of experiences among professionals of various backgrounds, as well as encouraging the cooperation and exchange of experiences and tools between different generations and levels of experience in a fashion dedicated to the accumulation of collective education and knowledge.
- Respecting principles of membership in regards to never being subjugated to harm, slander, false accusation, or violation of intellectual property rights.
2. MEMBERSHIP AND OBLIGATIONS
2.1 Minimum age
The Portal is not for use by anyone under the age of 13. However, if law requires that you must be older in order for DOX BOX e.V. to lawfully provide the services to you (including the collection, storage and use of your information) then the Minimum Age is such older age.
2.2 Becoming a member
To become a member, you must either:
2.2.1 be awarded the membership by DOX BOX, or
2.2.2 apply to become a member, and have your application approved in writing.
2.3 Automatic 1-year membership
Automatic 1-year membership is granted by DOX BOX in special cases:
2.3.1 If and when the Platform is upgraded, changed, modified, re-designed, revamped, given a new Uniform Resource Locator (URL), etc (new portal), all current and newly approved members will enjoy the privilege of automatic membership in the new portal, without the need for re-registration at the new website.
2.3.2 DOX BOX grantees (of support programs) are granted 1-year free-of-charge membership to the Portal.
2.4 Membership is personal
Membership is personal, you therefore agree:
2.4.1 to not let anyone else use your account
2.4.2 to accept responsibility for all activities that occur under your account or password.
2.5 The account and password should be guarded
To ensure the safety of membership accounts, you agree:
2.5.1 to choose a strong and secure password
2.5.2 To keep your password secure and confidential
2.5.3 To change your password and contact DOX BOX immediately if you suspect that someone may have obtained access to your password.
2.6 Geographic location of user
Although the Portal may be accessible worldwide, we do not claim that its Content is appropriate or available for use in locations outside Germany. Those who choose to access the Portal from outside Germany do so on their own responsibility, and are themselves responsible for compliance with relevant local laws.
3. RIGHTS AND LIMITS
3.1 On Portal Content and Intellectual & Audiovisual Rights
3.1.1 The portal ensures that no aspect of work can be violated either intentionally or unintentionally by providing a high level of digital data protection. You will put forth best efforts to learn about the intellectual property rights and the artistic rights and will not attempt to copy, acquire, quote, record, translate or share such works in part or in full without written clearance from the rights owners.
3.1.2 The Portal is for your personal and non-commercial use. You may not modify, copy, distribute, transmit, display, revise, perform, reproduce, publish, license, deep-link, create derivative works from, transfer, or sell or resell any audio-visual, written or any other Content on the Portal unless expressly authorised in writing by us. Accordingly, no Content may be used on another website without express written permission from DOX BOX.
3.1.3 Unless specifically authorized by DOX BOX, you may not copy, record or store such material in any form or medium in a retrieval system download and/or store any audiovisual Content or its equivalent, or transmit such material, directly or indirectly, for use in any paid service such as document delivery or list serve, or for use by any information brokerage or for systematic distribution, whether or not for commercial or non-profit use, nor for a fee, nor free of charge.
3.1.4 Unless otherwise indicated, all of the Content featured or displayed on this Portal, including, but not limited to, footage, images, audio, text, graphics, data, photographic images, moving images, sound, illustrations, design, software, and the selection and arrangement thereof, is owned by DOX BOX e.V., its licensors, or its third-party partners.
3.1.5 All elements of the Portal, including all Content, are protected by copyright, trade dress, moral rights, trademark and other laws relating to the protection of intellectual property. You agree to protect the intellectual property of DOX BOX, its affiliates, and their licensors.
3.1.6 Any intellectual property rights (including without limitation all copyright, database rights and trademarks (whether registered or unregistered)) subsisting in any Content or material on the Portal belongs to us and/or our licensors. All rights are reserved for the benefit of ourselves and/or our licensors.
3.2 Trademarks
All trademarks, registered trademarks, brand names, product names and company names or logos mentioned on the Portal are the property of their respective owners. Reference to any products, services, processes or other information, by trade name, trademark, manufacturer, and supplier or otherwise does not constitute or imply endorsement, sponsorship or recommendation thereof by us.
3.3 Availability of the Portal
The Portal is made available to you by us. Whilst we make every effort to ensure that the Portal is available, we do not represent, warrant or guarantee in any way the Portal’s continued availability at all times or uninterrupted use by you of the Portal. We reserve the right to suspend or cease the operation of the Portal from time to time at our sole discretion.
3.4 Limitation of access
We reserve the right to prevent or suspend your access to the Portal if you do not comply with any part of these terms or any applicable law. You represent and warrant that you will comply with all applicable laws and regulations, including, without limitation, those relating to the Internet, data, email, privacy, and the law on the transmission of technical data exported from Germany or the country in which you reside.
3.5 Your profile and its Content
As between you and DOX BOX, you own the Content and information that you yourself submit or post on your member profile (e.g. comments, biography), please note that:
3.5.1 other Members may access and share your Content and information, consistent with your settings.
3.5.2 while we may edit and make formatting changes to your Content (such as translating it, modifying the size, layout or file type or removing metadata), we will not modify the meaning of your expression.
3.5.3 you agree that we may access, store and use any information that you provide in accordance with the terms of the Privacy Policy and your privacy settings.
3.5.4 nothing in these terms and conditions grants you any rights to the Portal Content, as stated above in section 3.3.
3.5.5 You agree to only provide Content or information if that does not violate the law nor anyone's rights (e.g. without violating any intellectual property rights, or breaching a contract) and in accordance with Member Conduct as set forth in these Terms.
3.5.6 You also agree that your profile information will be truthful.
3.6 Members’ Submissions
3.6.1 We do not endorse the Content of any member submissions, and expressly disclaim any and all liability in connection with submissions.
3.6.2 We do not pre-screen or monitor submissions. However, we have the right at our sole discretion to remove any Content of any kind that, in our judgment, does not comply with our published Terms & Conditions or Law, or is otherwise harmful, objectionable, or inaccurate. We are not responsible for any failure or delay in removing such Content. You hereby consent to such removal and waive any claim against us arising out of such removal of Content.
3.6.3 If you would like to notify us of Content which you believe does not comply with these Terms, please e-mail us to community@dox-box.org. Make sure to include both the Uniform Resource Locator ("URL") for the non-complying video or Content, and the reasons you believe it does not comply.
3.6.4 You understand that in using the Portal, you may be exposed to materials that are objectionable as set forth in these Terms. You hereby waive and agree to waive all rights, claims, and actions in law or equity against DOX BOX arising from your exposure to such materials.
4. MEMBERS'S CONDUCT- DO'S AND DON'TS
4.1 Do’s
You agree to obey all applicable rules and regulations in using the Portal, and agree that you are responsible for the Content of your submissions or communications through the Portal, including Image Content, Musical Content, and Animoto Videos created therefrom (collectively, "Submissions"). You agree that you will:
4.1.1 Comply with all applicable laws and regulations, including, without limitation, privacy laws, intellectual property laws, anti-spam laws, export control laws, tax laws, and regulatory requirements;Provide accurate information to us
4.1.2 Use the Portal in a professional manner
4.2 Don’ts
4.2.1 You may not use your account to breach security of another account or attempt to gain unauthorized access to another network or server. Users who violate systems or network security may incur criminal or civil liability.
You agree that you will not upload, post, or transmit (collectively, "submit") any video, image, text, audio recording, or other work (collectively, "Content") that:
4.2.2 is unlawful, threatening, abusive, harassing, defamatory, libelous, deceptive, fraudulent, invasive of another's privacy, or impersonate another person;
4.2.3 contains explicit or graphic descriptions or accounts of sexual acts (including but not limited to sexual language of a violent or threatening nature directed at another individual or group of individuals), or in any way violate child pornography laws;
4.2.4 victimizes, harasses, degrades, or intimidates an individual or group of individuals on the basis of religion, gender, sexual orientation, race, ethnicity, age, or disability;
4.2.5 violates intellectual property rights of others, including patents, trademarks, trade secrets, copyrights or other proprietary rights
4.2.6 constitutes unauthorized or unsolicited advertising, junk or bulk email (also known as "spamming"), chain letters, any other form of unauthorized solicitation, or any form of lottery or gambling;
4.2.7 contains software viruses or any other computer code, files, or programs that are designed or intended to disrupt, damage, or limit the functioning of any software, hardware, or telecommunications equipment or to damage or obtain unauthorized access to any data or other information of any third party;
4.2.8 contains measures that could be used to determine the architecture of the Portal, or could be used to decompile, disassemble, or reverse engineer the Portal; or
4.2.9 is to be used for a commercial purpose of any kind.
4.2.10 discloses information that you do not have the right to disclose (such as confidential information of others)
5. CHANGES IN THE TERMS & CONDITIONS
From time to time we will have make changes in these terms to make sure that they respond to the reality of the Community. You agree that:
5.1.1 DOX BOX reserves the right to amend or modify these Terms & Conditions from time to time. DOX BOX will notify you about major changes in the current terms by publishing a notification on the Portal or notifying you by email. In principle it is however your responsibility to check the terms and conditions from time to time.
5.1.2 your use of the Portal after changes in these terms have occurred will mean that you accept the amendments, modifications, or new conditions. If you do not want to be bound by such a change, you will need to terminate your registration, if any, and stop using the Portal. software
6. TERMINATION OF ACCOUNT
You agree that we may at any time, and at our sole discretion, terminate your account without prior notice to you if we suspect a violation of any of these terms, in addition to any other available remedies.
7. GOVERNING LAW
The laws of the state of Berlin, Germany, will apply to all matters relating to these Terms & Conditions, the use of this Portal and/or services provided through this Portal, without regard to its conflict of law provisions.
8. DISCLAIMER
Content on the Portal is provided for your general information purposes only and to inform you about the international landscape of documentary cinema and practice. It does not constitute technical, financial, legal advice or any other type of advice and should not be relied on as such for any purposes.
8.1 Warranties and Liability
The Portal and its Content are provided to you “as is” and we make no warranty or representation to you with respect to them. We exclude all representations, warranties, conditions and terms express, implied, or otherwise to the fullest extent permitted by law. We accept no liability for any special, indirect, incidental, consequential or economic loss, or any other losses, howsoever caused arising out of or in connection with these Terms.
We provide the Content on the Portal in good faith but give no warranty or representation that the Content is accurate, complete or up-to-date or that it will meet your requirements, nor that the Portal does not infringe the rights of any third party. We accept no responsibility or liability for your use of the Portal and its Content and your use is entirely at your own risk. While we take reasonable precautions to prevent the existence of computer viruses and/or other malicious programs on the Website, we accept no liability for them. We do not warrant that defects in the Portal or its Content will be corrected.
Information transmitted via the Portal will pass over public telecommunications networks. We make no representation or warranty that the operation of the Portal will be timely, secure, uninterrupted or error-free and disclaim all liability in that respect to the greatest extent permitted by law.
8.2 Indemnity
You indemnify and keep DOX BOX, its affiliates, officers, agents, partners and employees fully indemnified from and against any claim or demand, including reasonable attorneys fees, arising out of your Content and materials, your use of the Portal, your violation of these Terms or your violation of any third party's rights including such party's intellectual property or privacy right, copyrights and trademarks.
Nothing in these Terms affects any statutory rights that you are entitled to.

DOX BOX is committed to protecting your privacy. Please refer to our Privacy Policy for information on how we collect, use and disclose personal information.
Hyperlinks and third party Sites
The Portal may contain hyperlinks or references to external third party websites. Any such hyperlinks or reference is provided for your convenience only. We have no control over third party websites and accept no responsibility for any Content, material or information contained in them. The display of any hyperlink and reference to any third party website does not constitute an endorsement of such third party’s website, products or services. Your use of a third party site may be governed by the terms and conditions of that third party site. You will need to use your independent judgment regarding your interaction with such linked sites.
